Spill Prevention Control and Countermeasure Plans
The Oil Pollution Prevention Act of 1974 requires facilities with oil or fuel storage capacity greater than 1,320 gallons to develop and implement Spill Prevention, Control, and Countermeasures (SPCC) Plans. In 2003, EPA quietly proposed a final rule completely re-writing the SPCC plan rule (40 CFR 112). The new rule replaced several “shoulds” with “musts”, including a new requirement that visual inspections AND physical testing of tanks MUST be completed on a periodic basis. With these evolving changes, the SPCC Plans at most facilities need to be reviewed, revised and recertified by a professional engineer.
